New York Drug Possession Charges: From Misdemeanor to Class A-I Felony

New York Penal Law structures criminal possession of a controlled substance in degrees from 7th through 1st, with no 6th-degree offense. The degree that applies to any given case depends on the substance, the quantity, and whether intent to sell is alleged. Prior felony convictions can also trigger enhanced sentencing as a predicate offender.

Here is how the degrees break down:

7th degree (Class A misdemeanor): Covers possession of any controlled substance not otherwise specified. Carries up to 364 days in jail and fines up to $1,000.
5th degree (Class D felony): Typically involves specific substances or quantities that elevate the charge above misdemeanor level.
4th degree (Class C felony): Carries 1 to 5.5 years in prison and fines up to $15,000.
3rd degree (Class B felony): Carries 1 to 9 years in prison and fines up to $30,000.
2nd degree (Class A-II felony): Carries 3 to 10 years in prison and fines up to $50,000.
1st degree (Class A-I felony): The most severe charge, carrying 8 to 20 years in prison and fines up to $100,000.

Controlled substances under New York law include cocaine, heroin, methamphetamine, and prescription medications such as oxycodone or hydrocodone when possessed without a valid prescription. Possessing someone else’s prescription drugs, even in small amounts, can result in misdemeanor or felony charges.

Marijuana possession is handled separately. Adults over 21 may lawfully possess up to 3 ounces for personal use, but larger quantities or other circumstances can still lead to charges. New York also provides limited overdose immunity under Penal Law 220.78 for individuals who seek emergency medical assistance in good faith for a drug overdose, covering both the person in crisis and the person who calls for help.
