Criminal Sale of a Controlled Substance: Degrees & Exposure

New York charges drug distribution and sale offenses as criminal sale of a controlled substance under Penal Law Article 220. There are five degrees, and every one of them is a felony. The charge you face depends on the substance involved, the quantity, and the circumstances of the alleged sale.

The five degrees carry the following exposure:

5th Degree (PL 220.31, Class D felony): Any knowing and unlawful sale of a controlled substance, regardless of quantity. The lowest charge, and still a felony.
4th Degree (PL 220.34, Class C felony): Applies to specific substances or quantities above the 5th-degree threshold.
3rd Degree (PL 220.39, Class B felony): Sale of narcotic drugs, methamphetamine above threshold, stimulants over one gram, or sale of a narcotic preparation to a person under 21. Carries up to 25 years.
2nd Degree (PL 220.41, Class A-II felony): Sale of a narcotic drug weighing half an ounce or more, or methamphetamine and stimulants above defined thresholds.
1st Degree (PL 220.43, Class A-I felony): Sale of two or more ounces of a narcotic drug, or 2,880 milligrams of methadone. This is the most serious drug felony in New York and carries a possible life sentence.

Two additional charges expand exposure further. Sale in or near school grounds (PL 220.44) is a separate Class B felony triggered when a qualifying sale occurs on school property or a school bus. Operating as a major trafficker (PL 220.77) is an aggravated offense for large-scale trafficking operations.

A witnessed transaction isn’t required to bring charges. Prosecutors may build distribution cases from quantity alone, packaging materials such as scales or baggies, large amounts of cash, multiple cell phones, surveillance footage, or informant testimony. Prior felony convictions can trigger predicate felony offender sentencing, which can raise the mandatory minimum at every degree.

State-level distribution charges in Binghamton are prosecuted by the Broome County District Attorney’s Office. Misdemeanor matters proceed in Binghamton City Court. Felony charges move to Broome County Court.
