Today, in Binghamton City Court, Nathen L. Jachimowicz (40 years old) of Binghamton, New York, was found NOT GUILTY of Assault in the Third Degree. Mr. Jachimowicz was represented by Thomas D. Jackson, Jr., Esq., of the law firm Jackson Bergman, LLP.
The bench trial took place on April 12th and 14th of 2021 before the Honorable William C. Pelella. This morning, Judge Pelella announced the not guilty verdict.
Mr. Jachimowicz was accused of assaulting another person on June 13, 2020. Mr. Jachimowicz advanced a justification defense. The proof at trial established that the complainant initiated the physical altercation and that Mr. Jachimowicz acted in self-defense.
